1. Introduction & Acceptance
Welcome to Hero Dial Call Center LLC ("Hero Dial"). These Terms of Service ("Terms") govern your engagement with our appointment-setting, lead generation, inbound support, and complete call center department solutions. By using our services, you (the Client) agree to these Terms. If you disagree with any part of them, please refrain from using our services.
2. Services Provided
Scope: Hero Dial offers a comprehensive suite of services including inbound/outbound call support, appointment setting, lead generation, and the buildout of call center departments. We deploy human reps complemented by AI-assisted workflow through our SolutionsAF.net platform.Campaign Specifics: Each campaign carries its own service package detailing scripts, qualification criteria, and operational guidelines as outlined in the specific service addendum. AI Assistance: Our AI technology is solely used to assist our workflow—it does not handle critical or outgoing calls. Please note that outcomes may vary based on this integration.
3. Payment & Billing
Billing Cycle: Weekly invoices are issued to our Clients.Payment Methods: Each invoice includes a payment link supporting multiple payment options.Late Fees: Should payment be delayed beyond 5 days, a late fee of $25 will be applied, with an additional $25 charged for each subsequent week of non-payment.Refunds & Failed Bookings: For appointments deemed “failed bookings” (i.e., those not meeting the agreed qualification criteria), refunds will be processed as a deduction from your subsequent invoice. Disputes over appointment quality shall be resolved via review of call recordings and discussions with the relevant call representative.
4. Client Responsibilities
Essential Information: You must provide all necessary assets including scripts, a business overview, campaign goals, and a confirmed list of qualification criteria prior to service commencement.Timely Communication: We will not start a campaign until all required materials and feedback are received. Delays in furnishing this information will result in a suspension of services until the gap is closed.Calendar Availability: It is the Client's responsibility to ensure sufficient availability in their calendar to honor scheduled appointments.
5. Limitation of Liability
Cap on Liability: Hero Dial’s liability under these Terms is strictly capped at the total amount you paid in the previous billing cycle.Disclaimer: Under no circumstances shall Hero Dial be liable for any indirect, incidental, or consequential damages. We are also not liable for any actions dictated by federal, state, or local mandates.
6. Non-Solicitation & Client Conduct
Non-Solicitation: Clients are prohibited from directly hiring or soliciting any Hero Dial call representatives. Should you wish to hire a rep directly, you must purchase our complete call center package or incur liability for any resultant damages.Professional Conduct: We expect every interaction to maintain a level of professionalism. Should anyone working under Hero Dial be disrespected—such as being cursed at or spoken down to—we reserve the right to immediately suspend services. In such events, all outstanding balances remain due.
7. Recording, Data Ownership & Confidentiality
Call Recordings: We record calls for training and quality assurance purposes. All recordings remain the property of Hero Dial. Access to these recordings is granted on a case-by-case basis strictly for quality reviews or dispute resolution. Data Ownership: All generated data, including leads, call details, and appointment information, are the exclusive property of Hero Dial.Confidentiality: Both parties agree to maintain strict confidentiality. NDAs may be executed as necessary to protect proprietary and confidential information.
8. Campaign Modifications & Suspension of Services
Campaign Start: Services will only commence once all required information and materials have been provided.Suspension: If you delay providing necessary information or assets, Hero Dial reserves the right to suspend services until such time as all requirements are met.
9. Dispute Resolution
Mediation: Disputes arising under these Terms shall be resolved through mediation in accordance with Idaho law. Should a dispute be initiated by you, the Client, you will be responsible for any mediation costs incurred. Hero Dial will select the mediation provider.Simple Process: The mediation process will be straightforward, initiated by written notice (email to [email protected]), and managed by the chosen mediation provider.
10. Governing Law & Termination
Governing Law: These Terms shall be interpreted and enforced in accordance with the laws of Idaho.Client Termination: You may terminate these services by providing written email notice (to [email protected]) at least 7 days before the next billing cycle begins. All outstanding balances must be settled.Hero Dial Termination: Hero Dial reserves the right to terminate the agreement at any time. In such cases, you remain liable for any outstanding dues and past charges
11. Miscellaneous
Entire Agreement: These Terms, along with any service-specific addenda, comprise the full agreement between Hero Dial and the Client.Severability: If any provision here is deemed invalid or unenforceable, the remaining provisions will continue in full force.Modifications: Modifications to these Terms must be made in writing and agreed upon by both parties.
